Welcome to The Vintage You Collection! Every Vintage You portrait is individually created from your photograph and selected design to produce a one-of-a-kind piece of personalized vintage-inspired artwork.

Because your order is created specifically for you, please review the following terms before placing your order.

1. Photo & Likeness Authorization

By submitting a photograph, you certify that you own the photograph or have sufficient permission and authority to provide it for the creation of your Vintage You artwork and any merchandise you order.

You may not submit photographs or likenesses of another person without appropriate permission.

If a submitted photograph depicts a minor, you certify that you are the minor’s parent or legal guardian or that you have authorization from the minor’s parent or legal guardian to use the photograph and likeness for this purpose.

You agree not to submit photographs or other materials that infringe another person’s copyright, privacy, publicity, trademark, or other legal rights.

2. AI-Assisted Artistic Rendering

Vintage You portraits are custom artistic interpretations, not photographic reproductions.

Artificial intelligence and other digital design tools may be used as part of the creative process to transform your submitted photograph into artwork inspired by vintage American illustration and advertising art.

Although every reasonable effort is made to preserve recognizable characteristics and important features, the finished artwork will not be an exact reproduction of your photograph or appearance.

Variations in facial details, hairstyle, body positioning, clothing, colors, backgrounds, proportions, and other artistic elements are normal parts of the illustration process.

3. Customer Photo Quality

The quality of the finished artwork depends partly upon the quality of the photograph provided.

For best results, submit a clear, recent, well-lit photograph in which the subject’s face and distinguishing features are easily visible.

Blurry, heavily filtered, extremely small, obstructed, or poorly lit photographs may limit our ability to create an accurate likeness. We may request another photograph before beginning your order.

4. Personalization Requests

We welcome reasonable personalization requests submitted with your order, including preferences concerning hairstyle, glasses, colors, clothing, or features you especially want preserved.

Personalization requests are subject to artistic feasibility and the characteristics of the selected Vintage You design.

Choosing an established Vintage You design means that the overall concept, slogan, composition, style, and creative identity of that design remain substantially consistent with the original collection.

Requests requiring a substantially different concept, scene, composition, slogan, or original design may be considered custom design work and may require an additional fee.

5. Proof & Revision Policy

You will receive a digital proof of your personalized artwork for review before the artwork is finalized for merchandise production.

Your order includes one reasonable revision to the initial proof.

A reasonable revision may include adjustments such as correcting hair or eye color, removing or adjusting an accessory, correcting personalization text, or making a reasonable likeness-related adjustment.

A revision does not include creating an entirely different concept, changing to another Vintage You design after artwork has been created, repeatedly experimenting with alternative appearances, or substantially redesigning approved artwork.

Additional or substantial revisions may require an additional fee. If so, you will be informed before additional work is performed.

6. Customer Approval

Please review your proof carefully.

You are responsible for checking the likeness, spelling, wording, colors, personalization details, and overall design before giving final approval.

Once you approve the proof and the order is released for production, no further artwork changes or cancellations can be guaranteed.

Your approval confirms that you accept the artwork as presented and authorize us to proceed with production.

7. Personalized Orders & Cancellations

Because Vintage You artwork is created specifically for each customer, work may begin shortly after an order is placed.

If you wish to cancel an order, contact us as soon as possible.

Once custom artwork work has begun, a cancellation or full refund may no longer be available. Once a proof has been approved and merchandise has entered production, the order cannot ordinarily be canceled or changed.

8. Personalized Product Returns & Replacements

Vintage You merchandise is custom-made and produced specifically for you. Therefore, returns, exchanges, and refunds are generally not available for change of mind, incorrect size or color selection, or subjective preferences regarding artwork that was previously approved.

If your physical product arrives damaged, defective, misprinted, or with a qualifying manufacturing error, please contact us promptly and provide clear photographs showing the problem.

Claims should be submitted within 30 days of delivery.

Qualifying manufacturing issues may be eligible for a replacement, reprint, or refund, depending upon the circumstances and the policies and determination of the applicable print provider.

You are not required to accept merchandise that is materially different from the final artwork you approved due to a production error.

9. Print-on-Demand Production

Vintage You merchandise may be produced and fulfilled by third-party print-on-demand providers, including Printify and its print-provider network.

Minor differences in color, print placement, sizing, texture, or appearance can occur between a digital screen proof and a physical printed product and are not necessarily considered defects.

Production and shipping times are estimates and may be affected by the print provider, carrier, product availability, holidays, weather, or other circumstances outside our reasonable control.

10. Intellectual Property

You retain whatever rights you lawfully hold in the original photograph you submit and in your own likeness.

The Vintage You Collection, its original designs, slogans where protectable, layouts, templates, branding, graphics, creative concepts, and underlying collection artwork remain the intellectual property of their respective owner(s) and are not transferred to the customer through purchase.

Purchasing a Vintage You product does not grant permission to reproduce, manufacture, resell, distribute, license, or commercially exploit the underlying Vintage You design or artwork unless separate written permission has been granted.

Your purchase is intended for personal use and enjoyment unless otherwise agreed in writing.

11. Marketing & Portfolio Permission

Purchasing a Vintage You product does not automatically give us permission to use your submitted photograph or personalized portrait in advertising or promotional materials.

If you separately choose to grant marketing permission during checkout, you authorize Elsa Kurt and The Vintage You Collection to use your submitted photograph and/or finished Vintage You artwork for portfolio, website, social media, advertising, promotional, and marketing purposes.

Providing this permission is completely optional and is not required to purchase a Vintage You product.

12. Prohibited Submissions

We reserve the right to refuse or cancel requests involving material that we reasonably believe is unlawful, infringing, fraudulent, threatening, hateful, obscene, exploitative, deceptive, or otherwise inappropriate for The Vintage You Collection.

We may also refuse photographs or requests when there is reasonable concern that the customer does not have authorization to use the submitted image or likeness.

If an order is refused before custom work begins, the applicable amount paid will be refunded.

13. Customer Responsibility

By submitting an order, you represent that the information you provide is accurate and that you have the necessary rights and permissions for all photographs, names, text, and other material you provide.

You agree that you are responsible for claims arising from materials you submit when you did not have the legal right or authorization to provide those materials.

14. Limitation of Liability

To the fullest extent permitted by applicable law, liability relating to a Vintage You order will not exceed the amount actually paid for the affected product or service.

Nothing in these terms is intended to exclude or limit any consumer right or remedy that cannot legally be excluded or limited.

15. Changes to These Terms

These terms may be updated periodically. The terms in effect at the time an order is placed will govern that order unless otherwise required by law.
